(1) Introduction

Welcome to the Oakoutlet.co.uk terms of sale, which apply to all use of this website and do not affect your statutory rights.

By accessing this website and/or by placing an order you agree to be bound by the terms and conditions set out below and the extended terms which are set out in product descriptions pertaining to specific products. If you have any questions relating to these terms and conditions, or require further clarification please contact our Customer Services department by telephone on 01493 660766 during the advertised times on the contact us page, or by e-mail at sales@oakoutlet.co.uk. You should carefully read and fully understand these terms and conditions as you will be asked to expressly agree to them and to acknowledge your acceptance to be bound by these terms and conditions before placing an order.

We reserve the right to update this page as required and any changes will be effective immediately. Therefore you should check back before making subsequent orders to ensure you are fully up to date with our latest terms. If you do not agree to be bound by these terms and conditions you may not use or access this website.

(2) Interpretation

In these terms and conditions, "we" means Oak Outlet Furniture (and "us", "website" and "our" will be construed accordingly); and "you" means our customer or potential customer for products (and "your" and "the customer" will be construed accordingly).

(3) License to use website

Unless otherwise stated, we or our licensors own the intellectual property rights in the website and material on the website. Subject to the license below, all these intellectual property rights are reserved.

You may view, download for caching purposes only, and print pages from the website for your own personal use, subject to the restrictions set out below and elsewhere in these terms and conditions.

You must not:

(a)republish material from this website (including republication on another website); (b)sell, rent or sub-license material from the website; (c)show any material from the website in public; (d)reproduce, duplicate, copy or otherwise exploit material on our website for a commercial purpose; (e)edit or otherwise modify any material on the website; or (f)redistribute material from this website except for content specifically and expressly made available for redistribution (such as our newsletter).
(4) Acceptable use

You must not use our website in any way that causes, or may cause, damage to the website or impairment of the availability or accessibility of the website; or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.

You must not use our website to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit or other malicious computer software.

You must not conduct any systematic or automated data collection activities (including without limitation scraping, data mining, data extraction and data harvesting) on or in relation to our website without our express written consent.

(5) Order Process

The advertising of products on our website constitutes an "invitation to treat"; and your order for products constitutes a contractual offer. No contract will come into force between you and us unless and until we accept your order in accordance with the procedure detailed below.

In order to enter into a contract to purchase products from us, you will need to take the following steps: (i) you must add the products you wish to purchase to your shopping cart, and then proceed to the checkout; (ii) if you are a new customer, you must then create an account with us and log in; if you are an existing customer, you must enter your login details; (iii) once you are logged in, you must select your preferred method of delivery and confirm your order and your consent to these terms of sale; (iv) your card payment will then be taken using our payment provider Sagepay; (v) we will then send you an initial acknowledgement; and (vi) once we have checked whether we are able to meet your order, we will either send you an order confirmation (at which point your order will become a binding contract) or we will confirm by email that we are unable to meet your order.

We will not file a copy of these terms of sale specifically in relation to your order. We may update the version of these terms of sale on the website from time to time, and we do not guarantee that the version you have agreed to will remain accessible. We therefore recommend that you download, print and retain a copy of these terms of sale for your records.

The only language in which we provide these terms and conditions is English.

Before you place your order, you will have the opportunity of identifying whether you have made any input errors by reviewing the information you have entered. At this point you may correct those input errors before placing your order by reentering the correct information.

(6) The products

The quantity and description of the Products shall be as set out in our order confirmation. Please check this carefully and immediately notify us by email or telephone of any errors.

Product Description

Further Descriptions of each individual product are available on each product's specific 'product page'. However, we or our suppliers may make any changes in the specification of the products which do not materially affect their quality or performance without notice, especially when required to conform with any applicable statutory requirements where the products are supplied to our specification. Individual products or product ranges will have specific characteristics explained in their descriptions and these will form extended parts of these terms and conditions. For example where ranges are described as 'rustic' or 'reclaimed' within their product descriptions, imperfections in these products are to be expected and would be classed as acceptable characteristics, where as these may be classed as not acceptable in other product types. These extended terms form part of the overall terms and conditions of this website.

Product Photography

Photographs are for illustrative purposes only, and although we try to maintain the highest levels of accuracy, may not exactly match the product itself.

Product Finish and Colour

Please be aware that all furniture has variants of colour and we therefore cannot guarantee exact colour or wood grain matches. Colour variation can also occur due to the different properties of computer display equipment being used to view the product. Please do not rely on descriptive terms as an accurate colour guide as these are highly subjective to each individuals interpretation. If the exact colour of a product is critical please request further clarification or ask if it possible to view the product prior to purchase.

For example, a product finish described as 'white' may appear 'off white', 'cream', 'ivory' or 'champagne' in colour to different people. For this reason, perceived colour variance to that described will not be classed as a fault or reason for free return. If you are trying to match colours to existing furniture or if colour is critical please ask for further clarification.

Product Natural Characteristics

In particular when purchasing items made from natural materials such as Wood or Leather, the characteristics of this natural product will be retained or even accentuated in the manufacturing process as they are considered to form part of the unique attraction of this type of material. Therefore naturally occurring characteristics in these materials will not be classed as faults or reason for free return.

Product Dimensions

All measurements given are approximate and a 5% tolerance each way should be allowed for. Due to the handmade nature of some of our products the dimensions may even differ across several pieces of the same item. If an exact measurement is critical for an item's suitability to you (i.e. a bookshelf's width when fitting into an alcove may be crucial) then you must contact us by email at sales@oakoutlet.co.uk to request the exact measurement of the specific item we will be sending you. Otherwise an allowance of 5% either way to all advertised dimensions should be granted. Items that have dimensions within this tolerance and where no further clarification has been sort by you will not be classed as faulty or misrepresented.

Product State of Assembly

Products will be delivered in the assembly state as advertised in the product's description. This will be either "Self Assembly", "Knockdown" or "Fully Assembled" as defined below.

Self-Assembly Products:

Self Assembly products will be clearly identified on the items specific product page and description.

These products offer the most flexibility where access may be an issue as these boxes will fit into a majority of rooms. They are also relatively easy and cheap to transport and store and therefore offer incredible value for money. This type of furniture will be supplied in entirely component form, in most cases requiring all aspects of assembly to be completed. This includes constructing carcasses, making drawer boxes, attaching all fittings including hinges and handles. Some gluing and basic cabinet making will be required. A vast majority of these products are pre-finished for you and therefore don't require or allow any further finishing to the surfaces.

Although clear instructions are provided some d.i.y skills would be an advantage. All assembly time guidelines given in the product descriptions have been timed in our own workshops by staff members who perform assembly on a daily basis. Your own assembly times may be different - but to complete the process in the fastest possible time always give yourself plenty of working area, use the correct tools and always read the instructions.

IMPORTANT: Self Assembly products may comprise of many components. In the unlikely event that you are missing a piece or a component is damaged, please notify us by email or telephone, clearly identifying which pieces are affected. We will send a free of charge replacement component by first class post or courier as quickly as possible. As components may be easily misplaced or damaged during the assembly process, a reported missing part which can be rectified by us in reasonable time and free of charge to you, will not be classed as a faulty product and is not reason for return. Self Assembly products are not returnable once assembly has been started.

Knock Down Products:

Products supplied in "knock down" form will be clearly identified on the items specific product page and description as Minimal Assembly Required.

These products are designed to offer the best of both worlds. Packed into smaller and more manageable boxes than their equivalent, fully assembled furniture and allowing access into more difficult rooms, but then extremely quick and easy to fully assemble once in position.

These items are of high quality, usually offering the same joinery methods of high quality, fully assembled furniture and innovatively designed to allow fast and solid final construction. For example, a "knockdown" wardrobe from our Oak Furniture Range is entirely constructed of solid materials, is properly jointed using traditional techniques and the drawers even have dovetail joints. However, the wardrobe will be broken down into smaller packages than if fully assembled. In the factory it is first fully assembled to check quality and then hand finished, but after it has passed QC it is then partly disassembled and boxed. Once delivered to your room of choice you are then just required to unpack, lift the top on the base, and bolt together - only taking about 10 minutes.

Fully Assembled Products:

Fully Assembled products will be clearly identified on the items specific product page and description.

These products are delivered completely constructed and not requiring and structural assembly; however some minimal finishing touches may be required. In a majority of cases, fully assembled items that have handles (i.e. a chest of drawers) will need the handles attaching to the drawer fronts. This is typical in the furniture industry as handles tend to protrude outside of the items footprint and are susceptible to be damaged or cause damage to other furniture in transit. Also items with delicate feet (i.e. a sofa with turned foot and castor) will be delivered with the feet requiring attaching. In the whole, once in your room of choice, fully assembled furniture requires only a few moments attention before its ready to be used. However, please carefully check access to your room of choice as these items can be big, especially when still packaged.

Product Packaged Dimensions

The packaged dimensions of products are available on request and are to be considered during your product selection. All products are delivered packaged and therefore your property should allow enough access space for the product to be carried through it and into the room where you wish the product to be placed. Insufficient access is not a reason to decline a delivery and any costs incurred by us for returns made on this basis will be fully chargeable to you. If our delivery service is unable to deliver the items to your room of choice they will be placed at the furthest accessible point either inside or outside your property. If you decide to gain access to your room of choice by unwrapping the product, please retain all packaging as this will be required if a return is later necessary.

(7) Price and payment

Prices for products are quoted on our website. The website contains a large number of products and it is always possible that some of the prices on the website may be incorrect. We will verify prices as part of our sale procedures once your order has been received, but in the unlikely event that we have incorrectly priced an item, we reserve the right not to enter into a contract to supply goods that have been incorrectly priced, in which case you will be notified by email that we are unable to meet your order.

In addition to the price of the products, you will have to pay a delivery charge of £29 per order. This is a per-order charge regardless of item quantity and not per-item. In cases where we are awaiting some goods to come into stock to complete your order, we will hold all items on that order until we are able to deliver your completed order at one time. If you wish to have a separate delivery consisting of in stock items please place separate orders, however you will incur two delivery charges.

Payment must be made upon the submission of your order, allowing us to allocate stock to you from the soonest available deliveries to us. We may withhold the products and/or cancel the contract between us if the price is not received from you in full in cleared funds.

The prices on the website include all value added taxes VAT (where applicable).

Payment for all products must be made by the methods advertised as available on the website at the time of your order.

Prices for products are liable to change at any time, but changes will not affect contracts which have come into force.

(8) Your warranties

You warrant to us that:

(a)you are legally capable of entering into binding contracts, and you have full authority, power and capacity to agree to these terms of sale; (b)the information provided in your order is accurate and complete; (c)you will be able to accept delivery of the products; (d)you are resident in England, Wales or Scotland; (e)you are at least 18 years of age.

 

(9) Delivery policy

"We know how important the delivery of your purchase is and aim to deliver all products to you as quickly as possible and in perfect condition."

Delivery Areas
We deliver to UK mainland addresses only, including England, Wales and Scotland. Deliveries to more remote areas of UK mainland may have longer lead times or may not be possible. If you believe your address is in a remote location please contact us by phone or email to talk through the possible options before placing an order.

Delivery methods
To ensure you receive your order in the best possible condition we employ the services of a dedicated 2-man delivery company who have vast experience within the furniture industry. This has proven to almost completely eliminate damage in transit and is our preferred delivery method, used for the vast majority of orders.

However, if your order is particularly time sensitive, we do have access to other delivery methods such as National Couriers or Pallet Networks which may be able to meet your deadline. Please contact our customer services department on 01493 660766 if you have specific requirements and we will do our upmost to accommodate your request, and if necessary compile a suitable quotation. These alternative delivery methods will offer a reduced service level than our preferred method, but may speed up the delivery process. Alternative methods may not be available to all post code areas and are not suitable for delivery of certain products. On this basis we may decline to offer them for particular orders.

Arranging delivery
To keep charges for a 2-Man delivery service to a minimum and to reduce environmental impact by vehicles used, our delivery company operates in certain post codes on certain days. To ensure we are able to deliver your furniture, it is expected that someone over 18 will be available to accept delivery on one of two potential delivery dates offered by the delivery company. All deliveries will be made Monday to Friday.

Once your order is in stock we will make it available to our preferred delivery company unless we have agreed alternative arrangements with you and confirmed these in writing. You will then be contacted by the delivery company by the telephone number given with your order and a delivery day agreed. As standard you will be offered two dates for delivery and given an a.m. or p.m. time slot. To keep delivery timescales and avoid possible additional charges you should accept one of the delivery dates offered.

Delivery Timescales
Using our preferred two-man delivery service we aim to deliver all 'In Stock' orders within 14 days from the date we receive your cleared payment. Alternative delivery methods and certain post code areas in the Scottish Highlands will have different delivery timescales.

While we will endeavor to meet all our arrangements for delivery, due to reasons beyond our control we cannot guarantee 'on time' delivery for all orders. We will make every effort to inform you of any delays promptly after we are aware of them, but we will not be liable for any loss, damages or consequential loss arising from delayed delivery or deliveries that need to be rearranged.

Delivery Access
We will do our best to place your products in the room of your choice providing there is reasonable access. Using the packaged product dimensions requested, it is your responsibility to ensure that the products not only fit into their final location but that there is sufficient access throughout the entire route to this room inside your property.

If you are aware of any possible access restrictions into your property these should be discussed prior to ordering as the costs of returning items that don't fit or are undeliverable due to poor access will be deducted from any refund given. The outbound delivery charge will also be deducted from any refund given for failed deliveries which are not our fault.

Preparing for delivery
If you take advantage of our 2-man delivery, to your room of choice, you should take time to suitably prepare your property before the delivery of large items of furniture. It is entirely your responsibility to protect or remove ornaments and floor coverings along the entire route of delivery.

However please do not cover stairs as this may cause a trip hazard, or put blankets down on polished floors as this may cause drivers to slip.

We will not accept any claims for damage for items damaged during delivery.

During adverse weather conditions preparing an area for the delivery drivers to wipe their shoes just inside your front door and at the foot of unprotected staircases may be advantageous.

Please consider removing any delicate objects from walls or moving ornaments which may be easily damaged by the delivery personnel if such objects are obstructing access whilst they are carrying heavy products. Remember one of them will be walking backwards and any items in the way may be damaged or create a trip hazard.

Please also consider protecting floor coverings as you see fit along the route of delivery, as our delivery drivers are unable to remove protective footwear whilst making a delivery. Protecting the floor in the destination room with sheeting is also advised as boxes may have become dusty during the delivery process and whilst in storage.

If you do not wish delivery personnel to lean longer boxes against walls in destination rooms please make this expressly clear at point of delivery.

For the avoidance of any doubt and to stress the importance, the preparation for delivery to ensure adequate protection to your property is entirely your responsibility. We will not accept any claims for damage to any item in your home including (but not limited to) floor coverings, wall decoration, pictures and ornaments, which have not been adequately protected or removed prior to delivery.

Failed Delivery Charges
Delivering furniture is a very specialist and expensive exercise. Furniture is heavy, awkward and delicate, and therefore requires us to employ specialist 2-man delivery companies to facilitate the delivery properly.

To make buying furniture online more attractive we heavily subsidize the outbound delivery costs. However we are unable to absorb these high costs when deliveries aren't made and orders cancelled or deliveries rearranged through no fault of our own. It is therefore extremely important that you make someone available to take delivery on the dates arranged with our delivery company.

If you aren't available to take delivery on a prearranged date without sufficient notice to us, or if poor access does not permit delivery or if we are unable to deliver for any other reason through no fault of our own, and:

(1) this results in a cancelled order, then the entire cost of an outbound delivery (£79), the return delivery to us (unsubsidized and usually between £40 - £200) plus a restocking fee to cover our distribution center costs (equal to 20% of the value of goods cancelled) will be deducted from any refund given.

or:

(2) this results in arranging an alternative delivery date within 7 days of the original delivery date, then just a £29 redelivery fee will be payable prior to redelivery.

(For alternative delivery dates arranged beyond 7 days of original delivery date additional storage charges may be levied by our delivery service company. These will be discussed on a case by case basis and payable prior to alternate delivery arrangements being confirmed.)

We will arrange for the products to be delivered to the address for delivery indicated in your order.

(10) Risk and ownership

The products will be at your risk from the time of delivery. Ownership of the products will only pass to you upon the later of:

(a)delivery of the products; and (b)receipt by us of full payment of all sums due in respect of the products (including delivery charges).
We will be entitled to recover payment for the products even where ownership has not passed to you.

(11) Returns

Cooling Off Period

Under the Distance Selling Regulations, you may cancel a distance contract to purchase a product or products from us at any time within 14 working days after the day you received the relevant product or products (subject to the limitations set out below). This excludes any Personalised Products, Products Customised for you or Made to Measure Products purchased, which are non returnable.

In order to cancel a contract in this way, you must give to us written notice of cancellation. This can be done by email to sales@oakoutlet.co.uk quoting your order reference number, full name and address.

If you cancel a contract on this basis, you must promptly return the products to us, in the same condition in which you received them. Items must be returned in their original packaging and in re-saleable as new condition.

If you cancel a contract on this basis, you will be refunded in full the cost of the goods. However, we are unable to refund any initial outbound delivery charge you have paid, and you will be responsible for paying the cost of returning the product to us.

Please be mindful that until the product is safely returned to us it is your responsibility to ensure it stays in perfect condition. Returned items will be fully checked and photographed on return. Any items that are received by us in a damaged condition will not be eligible for return or refund, and any such items will be returned to you.

Where you wish to make a return you may opt for us to arrange for you the collection of the items through our preferred delivery services, this is usually the most comprehensive and cost effective service available. The cost of this service will be agreed with you before arrangements are made and then deducted from your refund. Costs of return are usually charged at 20% of the item value, but extra charges may apply depending on your location and availability.

If you cancel a contract on this basis and you do not return the products to us, we may recover the products and charge you for the costs we incur in doing so. Similarly, if you return the products at our expense, we will pass that expense on to you.

Damaged/Faulty Items

During delivery you should check the condition of all packaging. Any obvious signs of damage to packaging should be reported to the delivery team and documented on the delivery note. The item with damaged packaging should be carefully unpacked by the drivers onsite and inspected for damage to the product. Any damaged product should be repackaged into its original packaging and returned with the drivers. You should clearly mark on the delivery note which package has been returned with the drivers by noting the product code on the delivery note. In this instance you must get the driver to sign your copy of the delivery note, confirming they have retained that item.

Without exception all items should be unpacked and checked within 48 hours of delivery. We are unable to accept claims for damage outside of this time limit. Items which have been delivered damaged or are faulty must be reported to our customer services department by email to: sales@oakoutlet.co.uk within 48 hours of delivery.

In the unlikely event that your item is found to be damaged after you have received delivery (but reported within 48-hours of delivery) we will ask for photographs to be emailed to our customer services department to help us assess the damage.

Please note that naturally occurring characteristics in natural materials, such as knots or shakes in wood or markings or scars in leather will not be classed as faults or cause for return. These will be categorised at our sole discretion following photographic assessment.

If stock levels allow, we will replace damaged items as soon as possible using our preferred delivery service explained above. We will collect the damaged items at the point of delivery of the replacement items. We will pay all delivery costs involved in replacing the damaged item and the quick replacement of items will be our priority. However, we will not be liable for any loses, costs incurred or consequential loss resulting from a replacement delivery being necessary, including (without limitation) time being taken from work to await replacement items.

Damaged items will be classed as individual items and will be replaced as such. In no way will damage to individual items class the whole consignment as damaged or entitle you to a free return of the whole order.

In cases where no obvious signs of damage were marked on the delivery note, and we have reason to believe damage has been caused by the customer, we reserve the right to not accept returns or to not replace items.

Items awaiting replacement should be kept in a suitable location as not to allow further damage.

To minimise damage please always be extremely careful when unpacking items and for larger items at least 2 people should be used to unpack.

(12) Statutory rights

Nothing in these terms of sale affects your statutory rights (including your right to receive a refund in respect of any defective product we sell to you).

(13) Refunds

If you cancel a contract and are entitled to a refund, we will usually refund any money received from you using the same method originally used by you to pay for your purchase. We will process the refund due to you as soon as possible and, in any event, that (when required) goods have been promptly and safely returned, within 30 days of the day we received your valid notice of cancellation.

(14) Limited warranties

Whilst we endeavor to ensure that the information on this website is correct, we do not warrant its completeness or accuracy; nor do we commit to ensuring that the website remains available or that the material on the website is kept up-to-date.

To the maximum extent permitted by applicable law we exclude all representations, warranties and conditions relating to this website and the use of this website (including, without limitation, any warranties implied by law of satisfactory quality, fitness for purpose and/or the use of reasonable care and skill).

All goods supplied by us come with a manufacturer's warranty of 12 months. We shall provide you with any information as is required to claim under the manufacturer's warranties and this may include you providing photographic evidence of the fault. In the event of a claim, you should first contact our customer service department.

We do not provide any warranty cover against defects in our own right. Except where the Buyer acts as a Consumer all other warranties, conditions and terms relating to fitness for purpose, satisfactory quality or conditions of the products whether implied by statute or common law or otherwise are excluded to the fullest extent of the law.

Insofar as is permitted by law, our only liability to you under these terms and conditions will be, at our sole discretion, to make good any shortage or non-delivery, to replace or repair any goods which are received by you in a damaged or defective state or to refund to you any sums actually paid by you for the goods in question. We will not be liable to you for any indirect or consequential loss or damage arising out of any problem you notify to us and will have no liability to you for any failure or delay in delivering goods or any damage or defect in goods delivered which is caused by any event or circumstance which is beyond our reasonable control.

Nothing in this Clause 5 affects your statutory rights as a consumer.

(15) Limitations and exclusions of liability

Nothing in the terms of sale will: (a) limit or exclude the liability of a party for death or personal injury resulting from negligence; (b) limit or exclude the liability of a party for fraud or fraudulent misrepresentation by that party; (c) limit or exclude any liability of a party under Section 12, 13, 14 or 15 of the Sale of Goods Act 1979 or Part I of the Consumer Protection Act 1987; (d) limit any liability of a party in any way that is not permitted under applicable law; or (e) exclude any liability of a party that may not be excluded under applicable law. Any statutory rights which you have as a consumer, which cannot be excluded or limited, will not be affected by the terms of sale.

The limitations and exclusions of liability set out in this Section and elsewhere in the terms of sale: (a) are subject to the preceding paragraph; and (b) govern all liabilities arising under the terms of sale or in relation to the subject matter of the terms of sale, including liabilities arising in contract, in tort (including negligence) and for breach of statutory duty.

We will not be liable to you in respect of any losses arising out of any event or series of events beyond our reasonable control.

We will not be liable to you in respect of any losses, including (without limitation) loss of or damage to profits, income, revenue, use, production, anticipated savings, business, contracts, commercial opportunities or goodwill.

We will not be liable to you in respect of any loss or corruption of any data, database or software.

We will not be liable to you in respect of any special, indirect or consequential loss or damage.

(16) General terms

We will treat all your personal information that we collect in connection with your order in accordance with the terms of our privacy policy; use of our website will be subject to our website terms and conditions.

Contracts under these terms and conditions may only be varied by an instrument in writing signed by both you and us. We may revise these terms and conditions from time-to-time, but such revisions will not affect the terms of any contracts which we have entered into with you.

If any provision of these terms of sale is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect, and such invalid or unenforceable provisions or portion thereof will be deemed omitted.

No waiver of any provision of these terms and conditions, whether by conduct or otherwise, in any one or more instances, will be deemed to be, or be construed as, a further or continuing waiver of that provision or any other provision of these terms and conditions.

You may not assign, charge, sub-contract or otherwise transfer any of your rights or obligations arising under these terms of sale. Any attempt by you to do so will be null and void. We may assign, charge, sub-contract or otherwise transfer any of our rights or obligations arising under these terms of sale, at any time - providing such action does not serve to reduce the guarantees benefiting you under these terms and conditions.

Each contract under these terms and conditions is made for the benefit of the parties to it and is not intended to benefit, or be enforceable by, any other person. The rights of the parties to terminate, rescind, or agree any amendment, variation, waiver or settlement under such contracts is not subject to the consent of any person who is not a party to the relevant contract.
